James McCulloch opened a branch of the 2nd national bank in Baltimore, MD. He refused to pay the tax that Maryland had issued on foreign banks. The case went all the way to the supreme court and there it was ruled that Marylad could not tax a branch of the Federal gov't. This set the precedent of Federal law/tax/policy having superioity of state law/tax/policy
