It is unlawful to act as a real estate broker or salesperson without first obtaining the proper license. According to the license law a real estate broker is defined as: 1. One who sells or offers for sale, lists or offers to list, buys or offers to buy real estate or business opportunities, or any interest therein, for others; 2. One who negotiates or offers to negotiate, directly or indirectly, the purchase, sale, exchange, lease, or rental of real estate or business opportunities, or any interest therein. 3. One who negotiates or offers to negotiate, directly or indirectly, the purchase, sale, or exchange of a manufactured or mobile home in conjunction with the purchase, sale exchange, rental, or lease of the land on which the home is or will be located. 4. One who advertises or holds himself out to the public by any oral or printed solicitation or representation that he or she is so engaged; or any transaction which results in or is calculated to result in any of these acts. 5. One who directs, assists, or engages in procuring prospects or in negotiating or closing any transaction which results in or is calculated to result in any of these acts. A real estate salesperson is someone who is employed by a real estate broker in the performance of any of the activities listed in the definition of a broker listed above. The following are not required to have a real estate license, even when their activities fall within the definition of broker or salesperson 1. Anyone buying or leasing property for himself, or on behalf of a group to which she belong, or disposing of property she owns or co-owns. 2. Authorized attorney in fact acting without compensation An attorney in fact is not necessarily a lawyer. It is anyone a principal appoints to act as her agent in a power of attorney 3. Attorney at law, in the performance of his/her duties. 4. A trustee in bankruptcy, executor, administrator, or guardian, when acting in that capacity, or any person acting under court order, or a trustee selling under a deed of trust. 5. Secretary, assistant, bookkeeper, accountant, or other office personnel performing purely clerical duties. 6. The owner of a rental property, or a member of the owner’s family, engaged in transactions relating to that property. 7. Anyone who manages residential property on an incidental basis and not as his/her principal source of income, as long as he/she doesn’t advertise or hold himself out as a property manager. 8. The resident manager of an apartment complex, in the performance of his/her duties related to that property 9. The owner manager of a self-storage facility renting units. 10.
