What is the Dram Shop Act?
Definition
  • Found in Section 1-10 of the General Obligations Law of the State of NY, states: 
  • Any persion injured in person, property...by any intoxicated person...shall have a a right of action against the person who shall, by unlawfully assisting in procuring liquor for such intoxicated person, have caused or contributed to such intoxication: and in any such action such person shall have a right to recover actual and exemplary damages.
  • Plaintiffs that sue under this act get: damages suffered as a result of injury by an intoxicated person
  • "Exemplary Damages" if it is proved that there was recklessness...wanton disregard of duty by bartender

  2. Suggesting non-alcoholic drinks
  3. Suggesting they have a glass of water before drinking any more
  4. Saying that you will be fired if you serve them, shifting the blame to the manager (last resort)
  5. Calling bouncer over to escort him out. Offer to call a taxi to make sure that individual gets home safely.
  6. Offer food (distraction)

Definition
  • It refers to any drink in the speed rack
  • Any liquor produced through distillation that does not contain sugar & has more than 20% ABV

ABV stands for Alcohol by Volume


refers to how much of the drink is alcohol and how much is water

What does it mean when an alcohol is 40% spirit?
Definition
it contains 40% pure alcohol and 60% water.

What does PROOF mean and what proof is 40% spirit?
Definition

Proof is equal to double the percentage so 40% spirit is considered 80 proof

 

Note: most spirits aren't more than 80 proof. the only exception is 99 bananas which is 99 proof

Liqueur is liquor that has sugar added and/or less than 40 proof.

 

They act to add a little extra flavor or aroma

  • clear, colorless, rather tasteless (bc distilled at a high proof)
  • light taste so it won't overpower in most drinks (that's why it's so popular in cocktails)
  • used to be made from potatoes, now made from grain
  • unaged, goes thru different types of filtration and distillation

  • clear, colorless, flavored with Juniper Berry
  • unaged and except for dilution in water, bottled directly from distillation
  • Invented by Dutch doctor to ward diseases
  • Never substitute Gin for Vodka

  • distilled from sugar cane or molasses
  • Light Rums (aka gold rum) are light brown colored and don't age longer than 6 months
  • Dark Rum results from longer aging process (3-12 yrs) and gets its color from added caramel (dark brown color)

  • caramel or amber color --> darker it is, the more aged
  • get color from contact with aged oak casks during aging

  • 2 types: single and blended (1. all products come from 1 distillery 2. composed of whiskies from 2 or more distilleries)
  • if malted, means it is distilled from a single malt grain
