Rational Basis Test
Definition
Rational basis review, in U.S. constitutional law, refers to a level of scrutiny applied by courts when deciding cases presenting constitutional due process or equal protection issues related to the Fifth Amendment or Fourteenth Amendment. It simply means that the government has a legitimate reason for a law or regulation that is rationally linked to it (in other words, the connection is not a non sequitur). Rational basis is the lowest level of scrutiny that a court applies when engaging in judicial review in the United States.

This test is the most deferential of the three levels of review in due process or equal protection analysis (the other two levels being intermediate scrutiny and strict scrutiny), and it requires only a minimum level of judicial scrutiny. E.g., courts use the rational basis test when analyzing the constitutionality of statutes involving age discrimination, disability discrimination, or the Congressional regulation of aliens.

Civil Rights Act 1964
Definition
The Civil Rights Act of 1964 (Pub.L. 88-352, 78 Stat. 241, enacted July 2, 1964) was a landmark piece of legislation in the United States[1] that outlawed major forms of discrimination against racial, ethnic, national and religious minorities, and women.[2] It ended unequal application of voter registration requirements and racial segregation in schools, at the workplace and by facilities that served the general public ("public accommodations").
Powers given to enforce the act were initially weak, but were supplemented during later years. Congress asserted its authority to legislate under several different parts of the United States Constitution, principally its power to regulate interstate commerce under Article One (section 8), its duty to guarantee all citizens equal protection of the laws under the Fourteenth Amendment and its duty to protect voting rights under the Fifteenth Amendment. The Act was signed into law by President Lyndon B. Johnson, who would later sign the landmark Voting Rights Act into law.

Gender Discrimination
Definition
Though gender discrimination and sexism refers to beliefs and attitudes in relation to the gender of a person, such beliefs and attitudes are of a social nature and do not, normally, carry any legal consequences. Sex discrimination, on the other hand, may have legal consequences.
Though what constitutes sex discrimination varies between countries, the essence is that it is an adverse action taken by one person against another person that would not have occurred had the person been of another sex. Discrimination of that nature is considered a form of prejudice and in certain enumerated circumstances is illegal in many countries.
Sexual discrimination can arise in different contexts. For instance an employee may be discriminated against by being asked discriminatory questions during a job interview, or by an employer not hiring or promoting, unequally paying, or wrongfully terminating, an employee based on his or her gender.

Title IX is a portion of the Education Amendments of 1972, Public Law No. 92‑318, 86 Stat. 235 (June 23, 1972), codified at 20 U.S.C. sections 1681 through 1688, U.S. legislation also identified its principal author's name as the Patsy Mink Equal Opportunity in Education Act. It states (in part) that

Weeks v. Southern Bell and Telegraph 1969

Lorena W. Weeks (born 1929) was the plaintiff in an important sex discrimination case, Weeks v. Southern Bell (1966). She claimed that Southern Bell had violated her rights under the 1964 Civil Rights Act when they denied her application for promotion to a higher paying position because she was a woman. She was represented in the case by Sylvia Roberts, a National Organization of Women attorney. She lost the initial case but won in 1969 after several appeals.Weeks v. Southern Bell was an important case as it marked the first victory in which NOW used the Civil Rights Act to fight gender-based discrimination. After her application for employment as an Alabama prison guard was rejected because the applicant, Rawlinson, failed to meet the minimum 120-pound weight, 5-foot-2-inch height requirement of an Alabama statute, Rawlinson sued. She challenged the statutory height and weight requirements and a regulation establishing gender criteria for assigning prison guards to "contact" positions (those requiring close physical proximity to inmates) as violative of Title VII of the Civil Rights Act of 1964. FRONTIERO v. RICHARDSON 1973

Facts of the Case
Sharron Frontiero, a lieutenant in the United States Air Force, sought a dependent's allowance for her husband. Federal law provided that the wives of members of the military automatically became dependents; husbands of female members of the military, however, were not accepted as dependents unless they were dependent on their wives for over one-half of their support. Frontiero's request for dependent status for her husband was turned down.

Definition
This suit was filed as a class action on behalf of present or former female employees of petitioner Los Angeles Department of Water and Power, alleging that the Department's requirement that female employees make larger contributions to its pension fund than male employees violated § 703(a)(1) of Title VII of the Civil Rights Act of 1964, which, inter alia, makes it unlawful for an employer to discriminate against any individual because of such individual's sex. The Department's pension plan was based on mortality tables and its own experience showing that female employees had greater longevity than male employees, and that the cost of a pension for the average female retiree was greater than for the average male retiree because more monthly payments had to be made to the female. The District Court held that the contribution differential violated § 703(a)(1), and ordered a refund of all excess contributions antedating an amendment to the Department's pension plan, made while this suit was pending, that eliminated sexual distinctions in the plan's contributions and benefits. The Court of Appeals affirmed.

Rostker v. Goldberg

Rostker v. Goldberg, 453 U.S. 57 (1981),[1] was a decision of the United States Supreme Court holding that the practice of requiring only men to register for the draft was constitutional.
On July 2, 1980, President Jimmy Carter re-established the Military Selective Service System with a recommendation that the Act be extended to include women. After extensive hearings, floor debate and committee sessions on the matter, the United States Congress enacted the law, as it had previously been, to apply to men only. Several attorneys including one Robert L. Goldberg subsequently challenged the gender distinction as unconstitutional. (The named defendant is Bernard D. Rostker, Director of the Selective Service System.)
In a 6-to-3 decision, the Supreme Court held that this gender distinction was not a violation of the equal protection component of the due process clause, and that the Act would stand as passed.

The case arose as a suit against the enforcement of provisions in a 1977 spending bill that required 10% of federal funds going towards public works programs to go to minority-owned companies.

Bakke, 438 U.S. 265 (1978) was a landmark decision by the Supreme Court of the United States that ruled unconstitutional the admission process of the Medical School at the University of California at Davis, which set aside 16 of the 100 seats for "Blacks," "Chicanos," "Asians," and "American Indians" (and established a separate admissions process for those 16 spaces).
The "diversity in the classroom" justification for considering race as "one" of the factors in admissions policies was different from the original purpose stated by UC Davis Medical School, whose special admissions program under review was designed to ensure admissions of traditionally discriminated-against minorities. UC Davis Medical School originally developed the program to (1) reduce the historic deficit of traditionally disfavored minorities in medical schools and the medical profession, (2) counter the effects of societal discrimination, (3) increase the number of physicians who will practice in communities currently underserved, and (4) obtain the educational benefits that flow from an ethnically diverse student body.

City of Richmond v. J.A. Croson Co., 488 U.S. 469 (1989) was a case in which the United States Supreme Court held that the city of Richmond's minority set-aside program, which gave preference to minority business enterprises (MBE) in the awarding of municipal contracts, was unconstitutional under the Equal Protection Clause. The Court found that the city failed to identify both the need for remedial action and that other non-discriminatory remedies would be insufficient.
Croson involved a minority set-aside program in the awarding of municipal contracts. Richmond, Virginia, with a black population of just over 50 percent had set a 30 percent goal in the awarding of city construction contracts, based on its findings that local, state, and national patterns of discrimination had resulted in all but complete lack of access for minority-owned businesses. The Supreme Court stated:
"We, therefore, hold that the city has failed to demonstrate a compelling interest in apportioning public contracting opportunities on the basis of race. To accept Richmond's claim that past societal discrimination alone can serve as the basis for rigid racial preferences would be to open the door to competing claims for "remedial relief" for every disadvantaged group. The dream of a Nation of equal citizens in a society where race is irrelevant to personal opportunity and achievement would be lost in a mosaic of shifting preferences based on inherently unmeasurable claims of past wrongs. [Citing Regents of the University of California v. Bakke]. Courts would be asked to evaluate the extent of the prejudice and consequent harm suffered by various minority groups. Those whose societal injury is thought to exceed some arbitrary level of tolerability then would be entitled to preferential classification. We think such a result would be contrary to both the letter and the spirit of a constitutional provision whose central command is equality."

California Proposition 209
Definition
Proposition 209 (also known as the California Civil Rights Initiative) is a California ballot proposition which, upon approval in November 1996, amended the state constitution to prohibit state government institutions from considering race, sex, or ethnicity, specifically in the areas of public employment, public contracting or public education. Modeled on the 1964 Civil Rights act, the California Civil Rights Initiative (CCRI), was authored by two California academics, Dr. Glynn Custred and Dr. Tom Wood. The political campaign to place CCRI on the California ballot as a constitutional amendment was initiated by Joe Gelman, Arnold Steinberg and Dr. Larry Arnn. It was later endorsed by Governor Pete Wilson, and supported and funded by the California Civil Rights Initiative Campaign, led by University of California Regent Ward Connerly. A Co-Chair of the Campaign was law professor Gail Heriot, who served as a member of the United States Commission on Civil Rights. The initiative was opposed by affirmative action advocates and supporters. Proposition 209 was voted into law on 5 November 1996, with 54 percent of the votes. In the November 2006 election in Michigan, a similar amendment was passed, entitled the Michigan Civil Rights Initiative.

Grutter v. Bollinger, 539 U.S. 306 (2003), was a landmark case in which the United States Supreme Court upheld the affirmative action admissions policy of the University of Michigan Law School. Justice Sandra Day O'Connor, writing for the majority in a 5-4 decision, ruled that the University of Michigan Law School had a compelling interest in promoting class diversity. The court held that a race-conscious admissions process that may favor "underrepresented minority groups," but that also took into account many other factors evaluated on an individual basis for every applicant, did not amount to a quota system that would have been unconstitutional under Regents of the Univ. of Cal. v. Bakke.

Gratz v. Bollinger, 539 U.S. 244 (2003),[1] was a United States Supreme Court case regarding the University of Michigan undergraduate affirmative action admissions policy. In a 6–3 decision announced on June 23, 2003, Chief Justice Rehnquist, writing for the Court, ruled the University's point system's "predetermined point allocations" that awarded 20 points to underrepresented minorities "ensures that the diversity contributions of applicants cannot be individually assessed" and was therefore unconstitutional.The University of Michigan used a 150-point scale to rank applicants, with 100 points needed to guarantee admission. The University gave underrepresented ethnic groups, including African-Americans, Hispanics, and Native Americans, an automatic 20-point bonus on this scale, while a perfect SAT score was worth 12 points.
The petitioners, Jennifer Gratz and Patrick Hamacher, both white residents of Michigan, applied for admission to the University of Michigan's College of Literature, Science, and the Arts (LSA). Gratz applied for admission in the fall of 1995 and Hamacher in the fall of 1997. Both were subsequently denied admission to the university. Gratz and Hamacher were contacted by the Center for Individual Rights, which filed a lawsuit on their behalf in October 1997.


The case was filed in the United States District Court for the Eastern District of Michigan against the University of Michigan, the LSA, James Duderstadt, and Lee Bollinger. Duderstadt was president of the university while Gratz's application was under consideration, and Bollinger while Hamacher's was under consideration. Their class-action lawsuit alleged "violations and threatened violations of the rights of the plaintiffs and the class they represent to equal protection of the laws under the Fourteenth Amendment... and for racial discrimination."

The Michigan Civil Rights Initiative (MCRI), or Proposal 2 (Michigan 06-2), was a ballot initiative in the U.S. state of Michigan that passed into Michigan Constitutional law by a 58% to 42% margin on November 7, 2006, according to results officially certified by the Michigan Secretary of State. By Michigan law, the Proposal became law on December 22, 2006. MCRI was legislation aimed at stopping the preferential treatment of minorities (by race, color, sex, or religion) in getting admission to colleges, jobs, and other publicly funded institutions. It was decried by some opponents as a repeal of the 1964 civil rights act.[1]

Fisher v. University of Texas (2012)
Definition
Fisher v. University of Texas is a case currently before the United States Supreme Court concerning the affirmative action admissions policy of the University of Texas at Austin. The case, brought by undergraduate Abigail Fisher in 2008, asks that the Court either declare the admissions policy of the University inconsistent with, or entirely overrule Grutter v. Bollinger, a 2003 case in which the Supreme Court ruled that race could play a limited role in the admissions policies of universities. An overruling of Grutter could end affirmative action policies in admissions at U.S. public universities.[1]
The United States District Court heard Fisher v. University of Texas in 2009 and upheld the legality of the University's admission policy. The case was appealed to a three-judge panel from the Fifth Circuit which also ruled in the University's favor. The Supreme Court agreed on February 21, 2012, to hear the case. Justice Elena Kagan has recused herself from the case.

Stenberg v. Carhart, 530 U.S. 914 (2000), is a case heard by the Supreme Court of the United States dealing with a Nebraska law which made performing partial-birth abortion illegal, without regard for the health of the mother. Nebraska physicians who performed the procedure contrary to the law were subject to having their medical licenses revoked. Nebraska, like many states, banned the procedure on the basis of public morality. The Court struck down the law, finding the Nebraska statute criminalizing "partial birth abortion[s]" violated the Due Process Clause of the United States Constitution, as interpreted in Planned Parenthood v. Casey and Roe v. Wade.


Facts of the Case
A Nebraska law prohibited any "partial birth abortion" unless that procedure was necessary to save the mother's life. It defined "partial birth abortion" as a procedure in which the doctor "partially delivers vaginally a living unborn child before killing the... child," and defined the latter phrase to mean "intentionally delivering into the vagina a living unborn child, or a substantial portion thereof, for the purpose of performing a procedure that the [abortionist] knows will kill the... child and does kill the... child." Violation of the law is a felony, and it provides for the automatic revocation of a convicted doctor's state license to practice medicine. Leroy Carhart, a Nebraska physician who performs abortions in a clinical setting, brought suit seeking a declaration that the statute violates the U.S. Constitution, claiming the law was unconstitutionally vague and placed an undue burden on himself and female patients seeking abortions. The District Court held the statute unconstitutional. The Court of Appeals affirmed.

Gonzalez Cases 2007

Gonzales v. Carhart, 550 U.S. 124 (2007), is a United States Supreme Court case that upheld the Partial-Birth Abortion Ban Act of 2003.[1] The case reached the high court after U.S. Attorney General Alberto Gonzales appealed a ruling of the United States Court of Appeals for the Eighth Circuit in favor of LeRoy Carhart that struck down the Partial-Birth Abortion Ban Act. Also before the Supreme Court was the consolidated appeal of Gonzales v. Planned Parenthood from the United States Court of Appeals for the Ninth Circuit, which had struck down the Partial-Birth Abortion Ban Act.
The Supreme Court's decision upheld Congress's ban and held that it did not impose an undue burden on the due process right of women to obtain an abortion, "under precedents we here assume to be controlling,"[2] such as the Court's prior decisions in Roe v. Wade and Planned Parenthood v. Casey. In a legal sense, the case distinguished but did not overrule Stenberg v. Carhart (2000), in which the Court dealt with related issues. However, Gonzales was widely interpreted as signaling a shift in Supreme Court jurisprudence toward a restriction of abortion rights, occasioned in part by the retirement of Sandra Day O'Connor and her replacement by Samuel Alito.[3][4][5] An editorial in the New England Journal of Medicine identified the case as a landmark: "This is the first time the Court has ever held that physicians can be prohibited from using a medical procedure deemed necessary by the physician to benefit the patient's health."[5]

Gonzales v. Planned Parenthood

In 2003, Congress passed and the President signed the Partial-Birth Abortion Ban Act. The controversial concept of partial-birth abortion is defined in the Act as any abortion in which the death of the fetus occurs when "the entire fetal head [...] or [...] any part of the fetal trunk past the navel is outside the body of the mother."

Planned Parenthood sued the Attorney General of the United States, arguing that the Act was unconstitutional under the right to an abortion protected by the substantive component of the Due Process Clause of the Fifth Amendment, as interpreted by the Supreme Court in Roe v. Wade and subsequent cases. The District Court agreed and stopped the Act from going into effect.

On appeal, the U.S. Court of Appeals for the Ninth Circuit affirmed. Though the government claimed that the Act banned only a narrow, rare category of abortions, the Circuit Court ruled that the Act applied to the common abortion procedure known as "D&E;" ("dilation and evacuation"), as well as to the far less common "intact D&E;," sometimes called "D&X;" ("dilation and extraction"). This made the ban expansive enough to qualify as an unconstitutional "undue burden" on the right to abortion, as defined in Planned Parenthood v. Casey.

The Ninth Circuit also ruled that the Act's lack of an exception for abortions necessary to protect the health of the mother rendered it unconstitutional. Congress had included in the Act a finding that partial-birth abortions were never medically necessary, but the Ninth Circuit held that the Supreme Court's decision in Stenberg v. Carhart required the health exception in all cases where medical opinion on the necessity an abortion procedure is divided.

Finally, the Circuit Court ruled that the Act was unconstitutionally vague, because the inclusion of ambiguous statutory terms such as "partial-birth abortion" would prevent physicians from knowing which methods of abortion were covered. The Circuit Court determined that the proper course of action was to block enforcement of the entire Act.

Dr. Harold Glucksberg, a physician—along with four other physicians, three terminally ill patients, and the non-profit organization, Compassion in Dying, counseling those considering assisted-suicide—challenged Washington state's ban against assisted suicide in the Natural Death Act of 1979. They claimed that assisted suicide was a liberty interest protected by the Due Process Clause of the Fourteenth Amendment to the United States Constitution.
The District Court ruled in favor of Glucksberg, but the United States Court of Appeals for the Ninth Circuit reversed. Then, after rehearing the case en banc, the Ninth Circuit reversed the earlier panel and affirmed the District Court's decision. The case was argued before the United States Supreme Court on January 8, 1997. The question presented was whether the protection of the Due Process Clause included a right to commit suicide, and therefore commit suicide with another's assistance. 1

McDonald v. Chicago, 561 US 3025 (2010), was a landmark[1] decision of the Supreme Court of the United States that determined whether the Second Amendment applies to the individual states. The Court held that the right of an individual to "keep and bear arms" protected by the Second Amendment is incorporated by the Due Process Clause of the Fourteenth Amendment and applies to the states. The decision cleared up the uncertainty left in the wake of District of Columbia v. Heller as to the scope of gun rights in regard to the states.
Initially the Court of Appeals for the Seventh Circuit had upheld a Chicago ordinance banning the possession of handguns as well as other gun regulations affecting rifles and shotguns, citing United States v. Cruikshank, Presser v. Illinois, and Miller v. Texas.[2] The petition for certiorari was filed by Alan Gura, the attorney who had successfully argued Heller, and Chicago-area attorney David G. Sigale.[3] The Second Amendment Foundation and the Illinois State Rifle Association sponsored the litigation on behalf of several Chicago residents, including retiree Otis McDonald.
The oral arguments took place on March 2, 2010.[4][5] On June 28, 2010, the Supreme Court, in a 5–4 decision, reversed the Seventh Circuit's decision, holding that the Second Amendment was incorporated under the Fourteenth Amendment thus protecting those rights from infringement by local governments.[6] It then remanded the case back to Seventh Circuit to resolve conflicts between certain Chicago gun restrictions and the Second Amendment.

On June 8, 1981, the Village of Morton Grove, Illinois' enacted Ordinance
No. 8 1-11,2 entitled "An Ordinance Regulating the Possession
of Firearms and Other Dangerous Weapons."3 To some, this ordinance
was the most draconian firearms legislation in the nation's history.
To others, it was a courageous first step in a bold social
experiment.4 Morton Grove became the nation's first community to
ban, with certain exceptions, the possession of handguns within its
borders.5
