Term
Kantian Confidentiality
Definition
- an essential part of autonomy. Not respecting a patient’s autonomy is to disrespect the patient.

- implied promise of confidentiality in fiduciary relationship - should be assumed by patient

- a necessary condition for the medical professional to do his/her work. The patient must be comfortable revealing potentially sensitive information in order for the proper course of treatment be undertaken.

- fiduciary relationship would be compromised without total trust
Term
Special and General Duties
Definition
Special = apply to individuals who occupy certain roles
General = apply to everyone

Confidentiality is a special duty that applies to dentists
Term
Ethical vs Legal
Definition
- that which is legal may not be ethical and vice versa

- professional obligations are not the same as legal obligations

- professional obligations require dentists to maintain confidentiality, but confidentiality may be given up required by law
Term
Kipnis View of Confidentiality
Definition
- all information shared with a practitioner is completely confidential - it cannot be shared unless the patient signs a consent form allowing the practioner to do so

Kipnis argues that confidentiality is meaningful only if it does not:

a) compromise any patient’s claim to absolute privacy;

b) balance competing claims to acquire identifiable patient data; and

c) promise something that a physician ultimately fails to deliver (strict confidentiality).
Term
Hodge View of Confidentiality
Definition
- patients regularly choose access to health services over personal confidentiality

- information must be shared for the health care system to work, yet any sharing is a breach of unqualified confidentiality

- assumption of absolute confidentiality implies that these data are more secure than they really are, and that patients themselves are not bound to protect that health and safety of others

- Pure Medical Confidentiality: patient's latent health status is only truly confidential prior to disclosing it to a physician

- we trade privacy for healthcare
